MedAnswers ("MedAnswers", "The Provider") is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data (as defined below) we collect from users of our website, located at https://www.medanswers.com"> https://www.medanswers.com, (the "Site"), our iPhone app "MedAnswers FertilityAnswers App" ("Software"), our Android app "MedAnswers Fertility App", FertilityAnswers, Fertility Wellness Prenatal DNA Test, and services provided through the Site or Apps ("Services"). The term "you" refers to the person visiting the Site.

User Consent

By using or visiting our Site or by submitting Personal Data through our Site, Software or Services, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your Personal Data in accordance with this Privacy Policy.

Children

Our Site, Software, and Services are not geared towards children under 18. Our Services may be used by minors under the age of 18 only if they are registered by a parent or guardian.

Users Outside of the United States

Personal Data may be processed in the country in which it was collected and in other countries. The Site, App and Services are hosted in the United States. If you are accessing the Site, App or Service from outside the United States, please be advised that the information you provide MedAnswers may be transferred to, processed and stored in the United States where the MedAnswers servers are located and our central database is operated. You acknowledge and understand that the data protection and other laws of the United States might not be as comprehensive as those in your country. Through your continued use of the Site, App or Service (which are governed by U.S. law, this Privacy Policy, and our Terms of Service), you consent to the transfer of your personal information to the United States. Genetic tests distributed through Helix or other 3rd party providers may not be available outside the United States.

Types of Data We Collect

With your consent, MedAnswers collects "Personal Data," "Genetic Data," and "Anonymous Data." "Personal Data" means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, email address, as well as any other information about you that is associated with or linked to any of the foregoing data. We do not share personal data without your consent with anyone or any third party. "Anonymous Data" means data not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. Genetic data is de-identified, except in the one-time delivery of your personalized report. We collect Personal Data, Genetic Data, and Anonymous Data, as described below:

a. Information You Provide to Us:

If you contact us via email, we will collect your name and email address, as well as any other data included in the email. If you register and use the Software we will collect your name and all other data provided as part of the registration process. We also collect any information uploaded or otherwise input by you while using the Software and Services, including, but not limited to, information related to your health history and other health-related information about you used for the sole purpose of assisting our experts in answering your questions.

b. Information Collected via Technology:

i. To make our Site, Software and Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and a date/time stamp for your visit. We also use cookies and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. "Cookies" are small pieces of information that a website sends to your computer's hard drive while you are viewing a web site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions. At this time, we do not recognize automated browser signals regarding tracking mechanisms, which may include "do not track" instructions. ii. We currently use Google Analytics. Google Analytics collects information anonymously and reports website trends without identifying individual visitors. Google Analytics uses its own cookie to track visitor interactions. Website owners can view a variety of reports about how visitors interact with their website so they can improve their website and how people find it. iii. We do not currently share any personal information of our Users with third parties for their direct marketing purposes. If our practices change we will notify you as required by applicable law.



Advertising and Marketing


MedAnswers hopes to deliver to you advertising for products and services you need or want. There fare many ways to do this in the online advertising world. For example, MedAnswers partners with websites and applications with whom you have shared your interests, conditions and concerns directly and asks that they serve our ads to users who have expressed an interest in MedAnswers products or health conditions that our products treat. We may also partner with advertising companies that may place or recognize a unique cookie on your browser (including through the use of pixel tags), or use other technologies, to serve you ads based on your web browsing activity, purchases, interests and/or other information—a practice commonly referred to as interest-based advertising (“IBA”) or online behavioral advertising (“OBA”). These advertising companies may also use these types of technologies to recognize you across the devices you use, such as a mobile phone or a laptop, and serve you ads on websites you visit and applications you use. Use of Your Personal Data. General Use

a. We use your Personal Data to:

i. Identify you as a user in our system.

ii. Identify you as a potential candidate to conduct research studies to improve fertility outcomes in which we would require your consent through an IRB approved study.

iii. Improve our Site, Software and Services.

iv. Provide the Services you request.

v. Send you administrative email or other notifications.

vi. Respond to your inquiries.

vii. Send you newsletters, surveys, offers, and other promotional materials related to The Provider products and services, including, but not limited to, the Site, Software and Services ("Promotional Emails").

b. Third Party Service Providers:

We may share your Personal Data with third party service providers: to provide you with the Site, Software and Services; to conduct quality assurance testing; to provide technical support; and/or to provide other services to The Provider. These third party service providers are required not to use your Personal Data other than to provide the services requested by The Provider. We will never share your genetic data with anyone.

c. Affiliates and Acquisitions:

We may share some or all of your Personal Data with our parent company, subsidiaries, joint ventures, or other companies under a common control ("Affiliates"), in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company, business, or our assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

d. Other Disclosures:

Regardless of any choices you make regarding your Personal Data (as described below), The Provider may disclose Personal Data if it believes in good faith that such disclosure is necessary.

Use of Your Genetic Data

We use your genetic data to create customize insight reports for your review and record only. While we do not share your individual genetic data with any 3rd party, the Company collects user information anonymously, including genetic variants, and reports app and user trends without identifying individual, registered users.

a. Third Party Service Providers:

We may share your Personal Data with third party service providers: to provide you with the Site, Software and Services; to conduct quality assurance testing; to provide technical support; and/or to provide other services to The Provider. These third party service providers are required not to use your Personal Data other than to provide the services requested by The Provider.

Third Party Website

When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. If you engage with our Site content through third-party social networking sites, we may have access to certain information associated with your social media account such as your name, email address, photograph, birthday, location, and people you follow or like. For information on controlling access to your personal information through social networking sites, you should review the social networking company's privacy policies and terms of use. You may choose to import information from other applications.

Your Rights Regarding Your Personal Data

a. We may periodically send you Promotional Emails (as described above):

When you receive Promotional Emails from us, you may indicate a preference to stop receiving further Promotional Emails from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the email you receive or by contacting us directly (please see contact information below). Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our Terms of Service for the Site, Privacy Policy or Software License Agreement for the Software.

b. Access to Personal Data:

If you wish to have access to the Personal Data that we have concerning you, or to have incorrect information updated please email us at privacy@ovum.md We will respond to your request within 30 days.

c. Retention and Deletion of Personal Data from Our App:

We will retain your information for as long as your account is active to provide your Services. You may request that we delete your Personal Data, but please note that we may be required to keep this information and not delete it under applicable law (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may retain your information as necessary to comply with our legal obligations, resolve disputes, enforce our rights, or similar purposes. Following any deletion request from our app, we may retain data related to your app account in aggregate form in case you want to reactivate your account at some point in the future. However, our third party partners may require a fully executed deletion of your genetic data, upon such request. In those cases, we delete your genetic profile according to their terms and conditions.

Security of Your Personal Data

The Provider is committed to protecting the security of your Personal Data. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while The Provider uses reasonable efforts to protect your Personal Data, The Provider cannot guarantee its absolute security.

Under certain circumstances, we may also elect to notify you of changes or updates to our Privacy Policy by other means, such as posting a notice on the front of our Site or by sending you an email.

The Genetic Information Nondiscrimination Act

The Genetic Information Nondiscrimination Act of 2008 (GINA) prohibits employers and other entities covered by GINA Title II from requesting or requiring genetic information of an individual or family member of the individual, except as specifically allowed by this law. To comply with this law, we are asking that you not provide any genetic information when responding to this request for medical information.
